01 Agreement to these terms

These Terms & Conditions ("Terms") are a binding agreement between you and ChargeZippy Solutions Private Limited, a private limited company incorporated in India on 3 April 2025, with its registered office at 1st Floor, 85/86/71, HS Tower, Hosur Road, Bommanahalli, Bengaluru, Karnataka 560068 ("ChargeZippy", "we", "us", "our").

They govern your use of our website, our mobile application, and the charge points we operate (together, the "Services").

By creating an account, starting a charging session, or otherwise using the Services, you accept these Terms. If you do not accept them, do not use the Services.

These Terms should be read together with our Privacy Policy and our Refund & Cancellation Policy, both of which form part of this agreement. This document is an electronic record under the Information Technology Act, 2000 and does not require a physical signature.

02 Definitions

  • Charge Point — any EV charging unit operated by us, or made available to you through us.
  • Session — a single, continuous period during which a Charge Point delivers energy to your vehicle.
  • Tariff — the rate at which a Session is billed, displayed in the app before you start.
  • Wallet — the closed-loop prepaid balance held in your account, usable only for ChargeZippy services.
  • Reservation — a Charge Point held for you for a defined slot, in return for a fee.
  • Site Host — the owner or occupier of the premises on which a Charge Point stands.

03 Eligibility

To use the Services you must:

  • be at least 18 years old and able to enter a binding contract under the Indian Contract Act, 1872;
  • provide accurate registration information and keep it current;
  • hold a valid driving licence and be lawfully entitled to operate the vehicle you are charging;
  • use a vehicle that is roadworthy and whose charging system is compatible with the Charge Point.

If you use the Services on behalf of a company or fleet, you confirm you have authority to bind that organisation, and "you" means both you and it.

04 Your account

  • You are responsible for keeping your credentials confidential, and for everything that happens under your account.
  • Tell us immediately at hello@chargezippy.com if you suspect unauthorised use. Until you do, you remain responsible for Sessions started with your account.
  • One person, one account. Do not share, sell or transfer your account.
  • You may close your account at any time — see Deleting your account in the Privacy Policy. Closing it does not extinguish amounts you already owe us.

05 Using the charging network

  • You are responsible for choosing a Charge Point and connector compatible with your vehicle. Charging with an incompatible or damaged connector may harm your vehicle, and that risk is yours.
  • Follow the instructions displayed on the Charge Point and in the app, and any signage or instruction given by the Site Host.
  • Charging speeds vary. The rate you actually receive depends on your vehicle, its battery temperature and state of charge, ambient conditions, and how many vehicles are drawing from the same site. We do not guarantee any particular charging speed or session duration.
  • Move your vehicle promptly once charging completes. Where idle or overstay fees apply, they will be disclosed in the app and at the Charge Point before you start.
  • Parking at a Charge Point is subject to the Site Host's rules. We are not responsible for parking charges, clamping or towing imposed by a Site Host or authority.

06 Safety

Do not use a Charge Point that appears damaged, exposed, scorched, wet inside, or otherwise unsafe. Report it to us immediately on +91 86060 66606 and do not attempt to connect.

  • Do not modify, open, repair or tamper with a Charge Point, or use an adapter or cable not approved for it.
  • Do not use a Charge Point in a way its manufacturer or these Terms do not permit.
  • Keep children and animals away from the cable and connector while charging.
  • In an emergency, use the emergency stop on the unit if fitted, and call the emergency services.
  • You must comply with all applicable laws and safety regulations while at a charging site.

07 Pricing, tariffs and fees

  • The applicable Tariff is shown in the app before you start a Session. By starting the Session you accept it.
  • Tariffs may vary by location, time of day, connector type and power level, and may change without notice — but never for a Session already in progress.
  • Sessions are billed per kWh delivered, per minute, or per session, as disclosed at the point of purchase.
  • All prices are in Indian Rupees (₹) and are inclusive of GST and other applicable taxes, unless stated otherwise at the point of purchase. A GST invoice is issued for every Session.
  • Additional fees — idle fees, reservation fees, minimum session fees — will be disclosed before they are incurred.
  • The energy measured by the Charge Point's meter is the definitive record of what was delivered, absent manifest error.

08 Payment and wallet

  • Payments are processed by Razorpay Software Private Limited, an RBI-authorised payment aggregator. We do not store your card number, CVV or UPI PIN — see the Privacy Policy.
  • We may place a pre-authorisation hold on your payment method when a Session starts, and capture only the actual amount due when it ends. See the Refund Policy.
  • Your Wallet is a closed-loop prepaid balance usable only for ChargeZippy services. It earns no interest, and money you have paid in does not expire. Promotional credit is not withdrawable as cash and may expire. See the Refund Policy.
  • You authorise us to charge your selected payment method for all amounts due, including any idle or overstay fees.
  • If a payment fails, we may suspend your ability to start new Sessions until the outstanding amount is paid.
  • You are responsible for any fee your own bank charges you, including foreign-transaction fees.
  • Invoices are issued electronically and are available in the app.

09 Refunds

Refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms. In summary: you pay for the energy you receive; if a Session fails and no energy is delivered, you are refunded in full; and energy already delivered to your battery cannot be refunded. Refund claims must be raised within 7 days of the Session.

10 Availability of the Services

We work hard to keep our network running, and we monitor it continuously — but we do not guarantee that any particular Charge Point will be available, operational, or free of faults at any given time.

Availability information in the app is provided in good faith and is usually live, but it may be out of date — for example if a vehicle has just connected, or a unit has failed and not yet reported it. You should not rely on it as a guarantee, and you should plan your journey with an adequate margin.

We may suspend Services for maintenance, upgrades, or reasons beyond our control, and we will give notice where it is practical to do so.

11 Acceptable use

You must not:

  • use the Services for any unlawful or fraudulent purpose, or to charge a vehicle you are not entitled to charge;
  • damage, tamper with, deface, or steal from a Charge Point, or steal electricity;
  • attempt to gain unauthorised access to our systems, probe or scan them, or disrupt them;
  • reverse-engineer, decompile or copy our app, except to the extent the law expressly permits;
  • use bots, scrapers, or automated means to access the Services;
  • submit false information, including a fraudulent refund claim or chargeback;
  • resell access to the Services without our written consent;
  • interfere with another user's Session, or obstruct access to a Charge Point.

Breach may lead to suspension or termination, and we may report unlawful conduct to the authorities and seek to recover our losses.

12 Intellectual property

The Services, and all content in them — including the ChargeZippy name and logo, the app, this website, its software, text, graphics and design — are owned by us or licensed to us, and are protected by intellectual property law.

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app and website to access the Services for your own, non-commercial use. That is all. You acquire no other rights, and you may not use our trade marks without our written permission.

If you send us feedback or suggestions, you agree we may use them without obligation or payment to you.

13 Third parties

  • App stores. If you obtained our app from the Apple App Store or Google Play, your use is also subject to their terms. Apple and Google are not parties to this agreement and have no obligation to provide support for the app. To the extent Apple's standard licensed-application end-user terms require it, Apple is a third-party beneficiary of these Terms and may enforce them against you.
  • Site Hosts. Charge Points stand on land owned by others. Their site rules — parking, access hours, conduct — apply to you while you are there, and we are not responsible for their acts or omissions.
  • Roaming partners. Where we give you access to a charge point operated by another network, that operator's terms may also apply to the Session.
  • Links. We are not responsible for the content or practices of any third-party website we link to.

14 Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available", and we make no warranties of any kind, express or implied, including as to merchantability, fitness for a particular purpose, or non-infringement.

In particular, we do not warrant that:

  • the Services will be uninterrupted, timely, secure or error-free;
  • any Charge Point will be available or functioning when you arrive;
  • any particular charging speed, session duration or state of charge will be achieved;
  • information in the app — availability, pricing, location — is always accurate or current.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under Indian law — including your rights as a consumer under the Consumer Protection Act, 2019.

15 Limitation of liability

Subject always to the box above, and to the fullest extent permitted by law:

  • We are not liable for indirect, incidental, special, punitive or consequential loss, or for loss of profit, revenue, business, goodwill, data, or anticipated savings — however caused.
  • We are not liable for damage to your vehicle or its battery, except where that damage is caused by our negligence or by a defect in a Charge Point we operate. Damage arising from your vehicle's own fault, an incompatible connector, or your failure to follow instructions is not our responsibility.
  • We are not liable for any loss arising from a Charge Point being unavailable, faulty, or slower than you expected — including a missed appointment, a delayed journey, or the cost of alternative transport.
  • Our total aggregate liability to you, for all claims arising out of or relating to the Services in any 12-month period, is limited to the greater of ₹10,000 or the total amount you paid us in the 3 months preceding the event giving rise to the claim.

16 Indemnity

You agree to indemnify us, and our officers, employees and agents, against any claim, loss, liability, cost or expense (including reasonable legal fees) arising out of:

  • your breach of these Terms;
  • your misuse of the Services or of a Charge Point;
  • damage you cause to a Charge Point or to a Site Host's property;
  • your violation of any law, or of the rights of a third party.

17 Suspension and termination

We may suspend or terminate your account, immediately and without refund of any non-withdrawable promotional credit, if:

  • you breach these Terms, in particular section 11;
  • we reasonably suspect fraud, theft of electricity, or abuse of the refund or chargeback process;
  • you owe us money that remains unpaid after we have asked for it;
  • we are required to do so by law.

We may also discontinue the Services, in whole or in part, on reasonable notice. If we do, we will refund any unused Wallet balance you have paid for.

Sections that by their nature should survive termination — including 12, 14, 15, 16 and 19 — survive it.

18 Changes to these terms

We may amend these Terms from time to time. The "Last updated" date at the top of this page will always show when we last did.

If a change is material, we will give you reasonable notice — in the app, by email, or by a notice on this website — before it takes effect. Continuing to use the Services after a change takes effect means you accept the amended Terms. If you do not accept them, stop using the Services and close your account.

19 Governing law and dispute resolution

These Terms are governed by the laws of India.

Talk to us first. Most problems are resolved quickly by our support team — write to hello@chargezippy.com. If that does not resolve it, escalate to our Grievance Officer, Mr Sivaprasad Damodaran, whose details are in the Privacy Policy. He will respond within 15 days.

Subject to the above, the courts at Bengaluru, Karnataka have exclusive jurisdiction over any dispute arising out of or relating to these Terms.

Nothing here affects your right, as a consumer, to bring proceedings before a Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.
